Suu Kyi cites widespread poll irregularities

YANGON, Myanmar (AP) ? Democracy icon Aung San Suu Kyi said Friday that Myanmar's weekend elections will be neither free nor fair because of widespread irregularities, but vowed to press forward with her candidacy for the sake of the country.

Suu Kyi said opposition candidates had been targeted in stone-throwing incidents and other intimidation that hampered their campaigning in the run-up to Sunday by-elections that are considered a crucial test of Myanmar's commitment to democratic reforms.

The 66-year-old Nobel peace laureate told a news conference that the irregularities go "beyond what is acceptable for democratic elections."

"I don't think we can consider it genuinely free and fair if we consider what has been going on for the last couple months," Suu Kyi said. "We've had to face many irregularities."

She said there were attempts to injure candidates and cited two cases in which stones or other objects were thrown at members of her opposition National League for Democracy, causing one of the party's security guards to be hospitalized.

There were "many, many cases of intimidation" and vandalism of party campaign posters.

She blamed some of the acts on "people in official positions."

Despite the irregularities, Suu Kyi said that the party is "determined to go forward because we think that is what our people want."

The by-election is likely to mark a symbolic turning point by bringing Suu Kyi into parliament for the first time, an event that would raise hopes for a more representative government after a half century of repressive military rule.

The by-election will fill 45 vacant seats in Myanmar's 664-seat national parliament.

A victory by Suu Kyi and the opposition would do little to alter the balance of power in parliament but would give her a voice in government for the first time.

WASHINGTON (AP) ? The survival of President Barack Obama's health care overhaul rests with a Supreme Court seemingly split over ideology and, more particularly, in the hands of two Republican-appointed justices.

Chief Justice John Roberts and Justice Anthony Kennedy put tough questions to administration lawyers defending the health care law during three days of arguments that suggested they have strong reservations about the individual insurance requirement at the heart of the overhaul and, indeed, whether the rest of the massive law can survive if that linchpin fails.

But Roberts and Kennedy also asked enough pointed questions of the law's challengers to give the overhaul's supporters some hope. In any event, justices' questions at arguments do not always foretell their positions.

The court's decision, due in June, will affect the way virtually every American receives and pays for health care and surely will reverberate in this year's campaigns for president and Congress. The political effects could be even larger if the court votes 5-4 with all its Republican-appointed justices prevailing over all the Democratic appointees to strike down the entire law, or several important parts of it.

Not since 2000, when the court resolved the Bush v. Gore dispute over Florida election returns that sealed George W. Bush's election as president, has a Supreme Court case drawn so much attention.

The court wrapped up public arguments Wednesday on the overhaul, which aims to extend health insurance to most of the 50 million Americans now without it. The first and biggest issue the justices must decide is whether the centerpiece of the law, the requirement that nearly all Americans carry insurance or pay a penalty, is constitutional.

Wednesday's morning session was unusual in that it assumed, for purposes of argument, a negative answer to that central question. What should happen to other provisions, the justices and lawyers debated, if the court strikes down the requirement? If the justices are following their normal practice, they had not even met to take a preliminary vote in the case before all argument concluded.

Questions at the court this week showed a strong ideological division between the liberal justices who seem inclined to uphold the law in its entirety and the conservative justices whose skepticism about Congress' power to force people to buy insurance suggests deep trouble for the insurance requirement, and possibly the entire law.

The divide on the court reflects a similar split in public opinion about the law, which Congress approved two years ago when Democrats controlled both the House and Senate.

Liberal and conservative justices alike appeared to accept the administration's argument that at least two important insurance changes are so closely tied to the must-have-coverage requirement that they could not survive without it: provisions requiring insurers to extend coverage to people with existing medical problems and limiting how much those companies can charge in premiums based on a person's age or health.

Less clear was whether the court would conclude that the entire law, with its hundreds of unrelated provisions, would have to be cast aside.

The justices also spent part of the day considering a challenge by 26 states to expansion of the federal-state Medicaid program for low-income Americans ? an important feature which alone was expected to extend coverage to 15 million people and which no lower court has rejected. The conservative justices appeared open to the states' argument that the expansion is unconstitutionally coercive.

Solicitor General Donald Verrilli Jr. took a few seconds at the end of the Medicaid argument to make a final plea for the court to uphold the entire law, which he said would "secure the blessings of liberty" for millions of Americans by providing them with affordable health care.

Verrilli told the court that Congress had made a policy decision to fight the high cost of medical care through the new law. "I would urge the court to respect that judgment," he said.

Paul Clement, the lawyer for the states challenging the law, answered that it would be a strange definition of liberty to make people who may not want it buy health care insurance. And he called Congress' threat to cut all Medicaid funding from states that refuse to expand the program "a direct threat to our federalism."

Crappy customer service: the real social media fail of big business ...

Every week I am astounded to hear or experience another example of a corporate or well-known brand failing to really grasp the opportunity for customer service and community that social media offers.

I can?t believe that we?re already a far way into 2012 and these multi-national million/billion dollar businesses still aren?t doing social media properly. Now is not the time to still be taking a ?softly, softly? approach. Now is the time to be getting your hands dirty, spending some big dollars and not just hiring one person but a whole team of people to look after your social media strategy.

But this particular Social Skinny rant needs to start with a story.

?

Last week I got a call on my mobile from the Commonwealth Bank, trying to sell me life insurance ? as you do. This in itself was no surprise but what did shock me was the level of (un)professionalism of the call. The woman was not at all articulate, seemed to have little idea of what she was doing, was competing with some seriously loud background noise to even speak to me and ? what really got me ? started laughing in the middle of talking about ?accidental death?. To get such an unprofessional call from any business would be surprising ? to receive it from the Commonwealth Bank, who in recent years I believe to have had much higher phone customer service standards ? was shocking.

?

Don?t get me wrong. It was not a huge deal ? not nearly the kind of thing I would bother writing an angry email or letter about or even posting a rant update on Facebook. In fact I found it more strange than anything else. However I did think it was worth shooting out a quick tweet about the situation, and including the @Commbank mention in there too. I would want to hear about such strange calls being made from someone at my company.? The tweet got a couple of replies from my Twitter followers and within an hour or so the Commonwealth Bank responded ? see below.

So let?s dissect this (fairly timely) tweet. They?ve used my name ? check. They?ve apologised ? check. They?ve defended themselves and pretty much dismissed my comment ? fail. I get what they were trying to do. I can even see the person reading my 140 char fly-away tweet about a bad customer service call and thinking ?what the hell do I say to this chick?? then they come up with some basic standard reply that proves they are ?listening? but doesn?t prove much else. Is that a helpful response to me? Does it make me feel better after the poor customer service I received to know that they strive to be professional at all times? No it?s not really helpful. It comes off looking corporate, defensive and generic. It also leaves almost a feeling that they don?t believe my situation ever happened because they try so hard to ensure it doesn?t ? allegedly.

?

Still, it?s no big deal. There was nothing for me to really say in response, so I figured I?d give the poor @CommBank tweeter a break and just ignore the situation. No plans of writing a social media case study. No plans of any rants. But, as it turned out, that was just the start of our twitter dance. Later that night, I was surprised to get yet another tweet from Commbank, despite the fact I never answered the previous one:

First of all I thought ? these people really don?t know what they are doing if they are responding twice to the same tweet within the same day. Weird. Then I thought ? maybe they checked up on who I was and saw I write a social media blog. In fact at the time the top article on my site was a social media case study on Scoot and how they were doing such a great job on Facebook. So the cynic in me begins to wonder whether these guys panicked when they saw the type of stuff I wrote about and figured they should probably put at least a little more effort into their interaction. Or maybe they just have a few people on the team who don?t pay attention to what the others have responded to. Or maybe they use a social media monitoring system that had me as flagged and because I didn?t respond they thought they?d tweet me again. Persistence is key?

?

Anyway who knows what tweeting processes the Commonwealth Bank has, but I decided to ignore this tweet too. I mean what did they expect me to say? Yes please can you give me a lowered home loan rate? There?s nothing they can do for me because the situation already happened. Do I want someone else to call me to sell me life insurance? No. I?m hoping not to die of accidental death, no matter how funny your staff members may find it. What they should have been asking was what I could do for them ? and that is to give them proper feedback so that perhaps they could look into the situation and make sure it didn?t happen again. But they chose to instead make a slightly more token effort to look like they cared, without offering anything that was constructive.

?

I wasn?t holding it against them. I thought ? well it?s an improvement, and you?re being persistent so whatever. But I still didn?t respond. What happens next? They tweet me again the next day:

If this hadn?t been the third tweet in 24 hours responding to just one of mine I would have thought ? job well done. This is exactly the sort of tweet I would expect ? personal, proactive and efficient. So, after receiving this tweet I did respond. I sent them a DM with my phone number and a note that it wasn?t a big deal but they could call me to get more details.

?

What happened then? Nothing. No contact from Commonwealth Bank. No follow up tweet. No phone call. Is it a sign that CommBank fails at social media? No it?s not. I think they are doing a better job than a lot of other banks and big businesses. But I still find it disappointing. Social media should not be an exercise in simply ?ticking a box?. It?s not just about being out there and sending token replies to your customers. It?s not just about appearances. There are two major opportunities that @CommBank has missed out on here: 1. Delight a customer (who in this case happens to be a social media commentator) and 2. Get real, helpful market insight and feedback to help improve your business.

Businesses spend a huge amount of money conducting surveys ? through phone and email ? of their customers in an effort to show they care about improving their business, and in some cases actually improving it. Social media is a much cheaper way to achieve this exact thing. It?s not just about making people happy and getting more sales. It?s about picking up the right insights to feed back into your organisation that truly help shape strategy, product development and customer experience.

I?ve used Commonwealth Bank as an example here, but the truth is they are just an example of almost all corporate companies on Twitter.? And most of the time it has nothing to do with the quality of the people who are behind the tweets. Most of the time it?s the company structure, support and resources. ?Big businesses almost always fail to recognise the immense power of social media, and the opportunities these channels present. Instead they simply think ?we need to be on there? because everyone else is. They then hire someone to look after this and leave it at that. In many cases they won?t even pay the right amount to get someone who really knows what they are doing. They are just concerned with ticking the box that they are ?doing? social media, rather than ?doing it properly?.

?

It?s probably unfair of me to single The Commonwealth Bank out in this article because ? like I?ve already said ? they are actually one of the better Australian big businesses using social media actively. Overall, they are doing a good job on there. My point is more that the senior management of CommBank ? and most other businesses ? should be more focused on empowering their SM teams to not just be good, but be great. Social media is probably the biggest opportunity for improved customer service and customer retention since CRM systems were introduced, and it?s being majorly underutilised at the moment in favour of the old ?tick a box syndrome?.

We need to take the focus off the so-called ?social media disasters? of big brands trying to use social media for marketing and engagement and start focusing on the core social media fail of not getting the simplest strategy ? customer service ? right.

A joint funeral service is being held in Israel for the victims of Monday's shooting at a Jewish school in the French city of Toulouse.

The bodies of 30-year-old Rabbi Jonathan Sandler, his sons Arieh, 5, and Gabriel, 4, and seven-year-old Myriam Monsonego arrived at Ben Gurion international airport ahead of a burial service in Jerusalem.?

The four were gunned down on Monday in the deadliest school shooting France has ever known and the bloodiest attack on Jewish targets in decades.

Lawyer: Afghan suspect's friend had leg blown off

SEATTLE (AP) ? The soldier accused of killing 16 Afghan villagers is expected to be flown to a U.S. military prison as early as Friday, a senior defense official said, as the soldier's attorney spoke of the impact the fighting had on his client.

The defense official, who spoke on condition of anonymity because of security surrounding the move, said the soldier would go the facility at Fort Leavenworth, Kan., the military's only maximum-security prison.

The suspect was moved from Afghanistan to Kuwait on Wednesday. Officials said that transfer was necessary because there was no appropriate detention facility to hold him in Afghanistan.

The official said the shift does not necessarily mean a decision was imminent on announcing formal criminal charges against the suspect.

The soldier's attorney, Seattle attorney John Henry Browne, told reporters Thursday that the day before the rampage, he saw his friend's leg blown off.

Browne told The Associated Press that his client's family provided him with details of the injury to another U.S. soldier. The details have not been independently verified.

"His leg was blown off, and my client was standing next to him," he said Thursday.

It isn't clear whether the incident might have helped prompt the horrific middle-of-the-night attack on civilians in two villages last Sunday. Browne said it affected all of the soldiers at the base.

The suspect had been injured twice during his three previous deployments to Iraq and didn't want to go to Afghanistan to begin with, Browne said.

Browne declined to release his client's name, citing concerns for the man's family, which is under protection on Joint Base Lewis-McChord, near Tacoma. But he said the soldier has two young children, ages 3 and 4.

FBI spokeswoman Ayn Dietrich in Seattle said the agency and the Department of Homeland Security issued a bulletin Thursday about the possibility of homegrown extremist retaliation for the shootings, but she said there's no specific target or credible information about an imminent attack.

The soldier, a 38-year-old father of two who is originally from the Midwest, deployed last December with the 3rd Stryker Brigade, and on Feb. 1 was attached to a "village stability operation." Browne described him as highly decorated and said he had once been nominated for a Bronze Star, which he did not receive.

He said the soldier and his family had thought he was done fighting. During tours in Iraq, the soldier suffered a concussive head injury in a car accident caused by a roadside bomb, Browne said, and he suffered a battle-related injury that resulted in surgery to remove part of his foot.

He was screened by health officials after the head injury before he redeployed, Browne said. He did not know if his client had been suffering from post-traumatic stress disorder, but said it could be an issue at trial if experts believe it's relevant.

He and the rest of his brigade had initially been told they wouldn't have to go to Afghanistan, Browne said.

Browne and his co-counsel, Emma Scanlan, said at a news conference at their Seattle law office that they had met with the soldier's wife and other family members, and Browne said he spoke briefly by phone with the soldier, whom he described as stunned and distant.

His family was "totally shocked," he said. "He's never said anything antagonistic about Muslims. He's in general very mild-mannered."

Browne said he knew little of the facts of the shooting, but disputed reports that a combination of alcohol, stress and domestic issues caused him to snap. He said the family said they were unaware of any drinking problem, and described the couple's marriage as "fabulous."

The soldier is accused of going on a shooting rampage in villages near his base in southern Afghanistan early Sunday, killing nine children and seven other civilians and then burning some of their bodies. The shooting, which followed a controversial Quran-burning incident involving U.S. soldiers, has outraged Afghan officials.

The suspect was flown out of Afghanistan on Wednesday evening to what officials describe as a pretrial confinement facility in Kuwait. Officials have anonymously described him as a father of two who has been in the military for 11 years. He has served three tours in Iraq and began his first deployment to Afghanistan in December.

The soldier asked to be represented by Browne, a well-known Seattle defense attorney, when he was taken into custody, the lawyer said.

Browne said he's spoken with the soldier, but did not discuss the substance of the allegations. He said the soldier had no prior events in his Army dossier indicating misbehavior.

Browne once defended serial killer Ted Bundy and recently represented Colton Harris-Moore, a youthful thief known as the "Barefoot Bandit."

Browne said he has only handled three or four military cases before. The soldier will also have at least one military lawyer.

Military lawyers say once attorneys involved in the initial investigation of an alleged crime involving a service member have what they believe to be a solid understanding of what happened and are satisfied with the evidence collected, they draft charges and present them to a commander.

That person then makes a judgment on whether there is probable cause to believe that an offense was committed and that the accused committed it.

That commander then "prefers" the charges to a convening authority, who typically is the commander of the brigade to which the accused is assigned but could be of higher rank.

There is nothing better than going on an adventure into the great outdoors and exploring the landscape on four wheels. Even if it is just you on your own out in the middle of nowhere, you still need to be aware for your own safety. Before you start off on your ride, you should always make sure both front and back breaks are working well. If your cable only goes a portion of the way to lock the wheels, then that means the brakes are working well. If you have to pull it all the way back and the wheel still moves then the cable has been stretched and needs to be adjusted or replaced. You should also check all your fluid levels ? oil, petrol, coolant and water to make sure that everything will continue to run smoothly throughout your ride. It is not necessary to wear protective clothing but it will help if you end up falling. Helmets and elbow guards will prevent scuff and bruises, but they encumber your ride and make it difficult to manoeuvre. Pants made of thicker materials, like jeans or cargoes will do just fine.

Take the bike for a quick spin around the yard before venturing out, just so you can get used to the bike first. Get a feel for the power and speed and then use that to make the most of your ride.
